1-2-Wonder Web Services Hosting account holders are a loyal bunch and we appreciate it. Now we want to reward you.

If you have web hosting with us, you can sign up for our Affiliate Program and every new web hosting customer which you refer to us will earn you a bonus of 105% of the new customer's first month's hosting fee.

To get credit for referrals:

• You must be a current 1-2-Wonder Web Services Hosting account holder (either a paid hosting account, or a free NPCS hosting account is fine).
• Your account must be active and in good standing both when the referred web hosting customer signs up and when your payment is issued to you.
• The referred customer's hosting account must remain active and in good standing without interruption due to suspension from nonpayment, terms of service violation, etc. during the entire 75-day hold period, in order for payment to be issued to you.
• Commissions are issued only for referrals of hosting customers (Standard Web Hosting and Premium Web Hosting). The 1-2-Wonder Web Services Hosting Affiliate program does not pay commissions on Domain Name Registrations, Setup Fees, Web Site templates, Web Development Services, or other services.
• If your Affiliate application is approved, you will be granted access to the "Affiliate Home" section of our site when you login at 1-2-Wonder Web Services. Here you can see your Affiliate Statistics, your own affiliate link information, and banners you can use on your web site/s.
• You can carry as many of our affiliate banners or affiliate link/s as you wish on your web site/s. If someone clicks on a link or banner on your site and orders a paid hosting package within 30 days, the sale is recorded via Cookies as coming from your affiliate ID and you get credit for the sale.
• You can get credit for word-of-mouth hosting referrals if you notify us via email of the referred customer, BEFORE the new customer signs up. Please provide the referred customer's name and domain name. If you do not follow this procedure you may not get credit for word-of-mouth referrals.
• You cannot refer yourself or get credit for extra hosting accounts you yourself sign up for. Affiliates will not get commissions from purchases made in/from their own 1-2-Wonder Member account/s.
• Referrals must be new customers of Paid hosting accounts who have signed up after July 20, 2003, which is when we opened our Affiliate program. In other words this Affiliate program is not retroactive.

How payment works:

• You get paid 75 days after the customer's first hosting invoice for the referred account has been paid. This delay is to guard against chargebacks, fraudulent signups with subsequent quick cancellations, suspensions caused by nonpayment or terms of service violations, or downgrades. If a hosting account referred by an affiliate is downgraded by the new customer during this 75-day hold period, the affiliate will be paid at the rate of the downgraded hosting plan's monthly fee.
• As a matter of standard practice, affiliate payments will be added as credited funds to your 1-2-Wonder Web Services Member Account after a 75-day hold period. This 75-day period does not start until the new customer's payment has cleared and his/her first hosting invoice has been paid in full. Once funds are deposited to your Member account, they are not retrievable as cash, but may be used to pay for your own hosting fees, future domain purchases, or other services.
• If you prefer NOT to have payments deposited to your 1-2-Wonder Member Account, but prefer instead to have your affiliate payments deposited as funds to your own PayPal account, you MUST SPECIFY to us that this is your preference within 7 days after we accept your Affiliate application. To do this, send an email to us at affiliates@12wonderwebservices.com. Be sure to include your real name and your 1-2-Wonder username. It will also be helpful if you provide the PayPal email address at which you will be accepting payments. We strongly suggest that if you will be receiving payments via PayPal, please enter your PayPal email address in the SECONDARY EMAIL field under "Edit Profile" in your "My Account" area at our web site. If you choose PayPal as payment method but we do not have a valid PayPal account email address to send payments to when they are due to you, we will deposit your affiliate payment into your Member account at 1-2-Wonder Web Services (see previous paragraph).
• PayPal charges recipients of funds a service charge fee for each transaction. This means that of the funds we send you, PayPal will deduct a small fee from your funds before they are made available to you. 1-2-Wonder will not be responsible for any service charges from PayPal. In other words, if you choose to get paid via PayPal, your net payment will be slightly smaller due to the fees charged by PayPal. If you choose to receive your payments via deposit to your 1-2-Wonder Member Account at our site, you will see the entire 105% for the hosting customer's first month credited to your account.

Cancellation of your participation in the 1-2-Wonder Affiliate Program:

• 1-2-Wonder Web Services Hosting Affiliates are subject to the same Terms of Service and Acceptable Use Policies as all other 1-2-Wonder account holders. SPAM WILL NOT BE TOLERATED UNDER ANY CIRCUMSTANCES. Not only is spam bad for our servers, it violates our ethics.
• If an Affiliate ceases to be a hosting account holder at 1-2-Wonder, his/her Affiliate status ceases at the same time and the Affiliate will receive no further referral credits or payments.

Other stuff:

• All income and other applicable taxes and/or fees are the responsibility of the Affiliate.
  

1) AGREEMENT. In this Affiliate Agreement ("Agreement") "you" and "your" refer to the individuals or companies that choose to participate in the 1-2-Wonder Web Services revenue sharing Affiliate Program, "we", us" and "our" refer to 1-2-Wonder Web Services.

2) Term of the Agreements: The term of this Agreement will begin upon our acceptance of your Affiliate application and will end when terminated by either party. Either you or we may terminate this Agreement at any time, with or without cause, by giving the other party written notice of termination. You are only eligible to earn referral fees on sales occurring during the term.

3) Representations: You agree that all your advertising and promotion of our services shall be truthful in nature. Any affiliate that falsely represents the services offered by 1-2-Wonder Web Services shall be immediately deactivated without receiving any commissions owed, and may be subject to criminal prosecution.

4) SPAM: You agree that you shall not advertise our services through SPAM, which we loosely define as unsolicited e-mailings or posting of messages to unrelated Newsgoups or Message boards. Furthermore, any method used for promotion of our services must not be in violation of the rules, or terms, of that promotional medium.

5) Modification: We may modify any of the terms and conditions contained in this Agreement and on this page, at any time and in our sole discretion, by posting a change notice and/or modifying this page on our website. Modifications may include, for example, changes in the scope of available referral fees, fee schedules, payment procedures and Program rules. IF ANY MODIFICATION IS UNACCEPTABLE TO YOU, YOUR ONLY RECOURSE IS TO TERMINATE YOUR PARTICIPATION IN THE AFFILIATE PROGRAM. YOUR CONTINUED PARTICIPATION IN THE PROGRAM FOLLOWING OUR POSTING OF A CHANGE OR NEW AGREEMENT ON OUR SITE WILL CONSTITUTE BINDING ACCEPTANCE OF THE CHANGE. If we deem that the changes to these terms are of significant nature, we will make an effort to notify you of the revised terms via the e-mail address that we have on record for you. It is our sole discretion as to what changes shall be considered "significant", and our failure to notify you of any changes to these terms SHALL NOT be viewed as a breech of this Affiliate Agreement.

6) Disclaimer of Warranty, Limitation of Liability: YOU AGREE THAT YOUR ACCESS TO AND USE OF THE SERVICE IS AT YOUR OWN RISK. NEITHER 1-2-Wonder Web Services NOR ITS SUBSIDIARIES, SHAREHOLDERS, MEMBERS, OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS OR SUBCONTRACTORS WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR AS TO THE ACCURACY, RELIABILITY, OR CONTENT WITHIN THE SERVICE. THE SERVICE IS PROVIDED ON AN "AS IS, AS AVAILABLE" BASIS WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSES AND NON-INFRINGEMENT. IN NO EVENT WILL 1-2-Wonder Web Services NOR ITS SUBSIDIARIES, SHAREHOLDERS, MEMBERS, OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS OR SUBCONTRACTORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES (EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT YOUR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE, INCLUDING WITHOUT LIMITATION, LOSS OF REVENUE OR ANTICIPATED PROFITS, LOSS OF GOODWILL, LOST BUSINESS, LOST DATA, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER DAMAGES OR LOSSES THAT RESULT FROM MISTAKES, INACCURATELY ENTERED DATA, UNAUTHORIZED USE, OMISSIONS, INTERRUPTIONS, ERRORS, DEFECTS, DELAYS IN OPERATION, OR ANY FAILURE OF PERFORMANCE, WHETHER OR NOT LIMITED TO ACTS OF GOD, COMMUNICATIONS FAILURE, THEFT, DESTRUCTION OR UNAUTHORIZED ACCESS TO INSTITUTIONS RECORDS, PROGRAMS OR SERVICES. YOU AGREE THAT THE FOREGOING LIMITATIONS OF LIABILITY REPRESENT A REASONABLE ALLOCATION OF RISK. Further, our aggregate liability arising with respect to this Agreement and the Program will not exceed the total referral fees paid or payable to you under to this Agreement.

7) Independent Investigation: YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL ITS TERMS AND CONDITIONS. YOU UNDERSTAND THAT THIS IS NOT A "RESELLER" PROGRAM, AND THAT ALL PRODUCTS AND SERVICES WILL BE SOLD DIRECTLY FROM 1-2-Wonder Web Services TO OUR CUSTOMERS, WHICH YOU REFER TO US. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF PARTICIPATING IN THE PROGRAM AND ARE NOT RELYING ON ANY REPRESENTATION, GUARANTEE OR STATEMENT OTHER THAN AS SET FORTH IN THIS AGREEMENT.

8) Entire Agreement: This Affiliate Agreement completely and exclusively states the agreement of the parties regarding the subject matter, and supersedes all prior agreements and understandings except those posted on this web page, whether written or oral, with respect to the subject matter of this Affiliate Agreement.

9) Breach: You agree that failure to abide by any provision of this Agreement may be considered by 1-2-Wonder Web Services to be a material breach and that 1-2-Wonder Web Services may terminate your affiliate status and withhold any commissions owed. Any such breach by you shall not be deemed to be excused simply because 1-2-Wonder Web Services did not act earlier in response to that, or any other breach by you.

10) Right of Refusal: 1-2-Wonder Web Services, in its sole discretion, reserves the right to refuse service to anyone for any reason. Your acceptance into our Affiliate Program is also at our sole discretion and may be refused for any reason.

11) Miscellaneous: This Agreement will be governed by the laws of US and the State of FL, without reference to rules governing choice of laws. Any action relating to this Agreement must be brought in the federal or state courts located in the State of FL, and you irrevocably consent to the jurisdiction of such courts. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of and be enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.
